Terms of Use

Please read these Terms of Use (“Terms”) carefully before using the ListingLedger mobile application (“App”) operated by Akar Software (“we,” “our,” or “us”). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using ListingLedger, you confirm that you are at least 18 years old and agree to comply with these Terms. If you do not agree to these Terms, you must not use the App.

2. Description of Service

ListingLedger is an IRS-compliant expense tracking application designed for real estate professionals. The App provides:

  • Automatic and manual expense tracking and categorization
  • Bank account connection and transaction syncing via Teller
  • Receipt scanning and AI-powered expense classification
  • GPS-based business mileage tracking
  • Property listing and client management
  • Business gift tracking with IRS limit monitoring
  • IRS Schedule C-compliant tax report generation

3. Account Registration

To use ListingLedger, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activity that occurs under your account

4. Subscriptions and Payments

4.1 Subscription Plans

ListingLedger offers free and paid subscription tiers. Paid features are accessible through in-app purchases processed by the Apple App Store.

4.2 Billing

  • All payments are processed through Apple’s App Store billing system
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period
  • You can manage or cancel your subscription through your Apple ID settings

4.3 Refunds

Refund requests are handled by Apple in accordance with their App Store refund policies. We do not process refunds directly.

5. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable laws
  • Attempt to reverse engineer, decompile, or disassemble the App
  • Interfere with or disrupt the integrity or performance of the App
  • Attempt to gain unauthorized access to our systems or networks
  • Use the App to store or transmit malicious code
  • Share your account credentials with third parties
  • Use automated scripts to collect information from the App

6. Financial and Tax Information Disclaimer

Important: ListingLedger is a record-keeping and expense tracking tool. The App does not provide tax, legal, or financial advice. Expense categorizations, mileage calculations, and generated reports are provided as organizational aids only. You are solely responsible for the accuracy of your tax filings. We strongly recommend consulting a qualified tax professional for tax-related decisions.

7. Third-Party Services

The App integrates with third-party services including Teller (bank connections), OpenAI (receipt analysis), and Google Places (address services). Your use of these services is subject to their respective terms of service. We are not responsible for the availability, accuracy, or conduct of third-party services.

8. Intellectual Property

All content, features, and functionality of ListingLedger—including but not limited to text, graphics, logos, icons, software, and design—are the exclusive property of Akar Software and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on any part of the App without our prior written consent.

9. User Data and Content

9.1 Your Data

You retain ownership of all data you enter into the App, including transaction records, receipts, property information, and client details.

9.2 License to Use

By using the App, you grant us a limited, non-exclusive license to process, store, and display your data solely for the purpose of providing the service to you.

9.3 Data Accuracy

You are responsible for the accuracy of data you enter or import into the App. We are not liable for any consequences arising from inaccurate data.

10. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The App is provided “AS IS” and “AS AVAILABLE” without warranties of any kind
  • We do not warrant that the App will be uninterrupted, error-free, or secure
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App
  • Our total liability to you shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim
  • We are not responsible for any tax penalties, missed deductions, or financial losses resulting from the use of or reliance on the App

12. Indemnification

You agree to indemnify and hold harmless Akar Software and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the App or violation of these Terms.

13. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms. Upon termination:

  • Your right to use the App will immediately cease
  • You may request export of your data before account deletion
  • Provisions that by their nature should survive termination (including liability limitations and indemnification) will remain in effect

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms within the App and updating the “Effective Date.” Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall be resolved in the applicable courts.
